Welcome to Wardy (“Service”), a platform designed to securely store and deliver your messages, videos, audio recordings, or physical packages to designated recipients after your passing. By using our Service, you agree to the following terms and conditions (“Terms”). Please read them carefully.
1. Acceptance of Terms By accessing or using Wardy, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you (“User”) and Wardy.
2. Description of Services Wardy offers subscription-based plans designed to facilitate the secure delivery of messages and packages. Level 1 includes the storage and delivery of text emails to up to three designated recipients. Level 2 encompasses the storage and delivery of text, video, and audio messages to designated recipients. Level 3 includes all features of Levels 1 and 2, along with the storage and delivery of a physical package anywhere in the world.
The Service relies on two trusted individuals (“Trusted Contacts”) designated by you to notify Wardy upon your passing. Following verification, we proceed with delivering your messages according to your instructions. Suggested uses for the Service include sharing sentimental messages with loved ones, providing critical personal or financial information such as insurance details and bank contacts, and conveying practical instructions like key locations or passwords. Wardy does not provide legal, financial, or medical advice, and the User assumes full responsibility for the content and consequences of the messages sent through the Service.
3. User Responsibilities As a User, you are responsible for providing accurate and up-to-date contact information for your Trusted Contacts and designated recipients. You must ensure the content of your messages complies with applicable laws and does not contain illegal, harmful, or offensive material. It is also your responsibility to keep your account credentials confidential and secure.
You agree not to use the Service to send messages that are fraudulent, defamatory, or intended to harm others. Additionally, you must refrain from engaging in activities that violate intellectual property rights, privacy laws, or any applicable regulations. Failure to adhere to these responsibilities may result in suspension or termination of your account.
4. Trusted Contacts Trusted Contacts play a vital role in the Service by notifying Wardy of your passing. You must designate two Trusted Contacts who will receive detailed instructions on how to activate the delivery process and provide verification of your passing as outlined by Wardy. Trusted Contacts must follow the verification process, which may include submitting documentation or other evidence requested by Wardy. Wardy reserves the right to request additional information or deny initiation of the delivery process if sufficient verification is not provided.
5. Subscription Plans and Fees Wardy operates on a subscription basis with three tiers of service. Level 1 offers basic email delivery, Level 2 provides multimedia message delivery, and Level 3 includes full-service delivery, including physical packages. Subscription fees are detailed on our website and may be updated periodically.
By subscribing, you authorize Wardy to charge your payment method for the subscription fee on a recurring basis. Subscription fees are non-refundable except as required by law. Partial refunds will not be provided for cancellations during an active billing period. You may upgrade or downgrade your subscription plan at any time, with changes taking effect at the start of the next billing cycle.
6. Data Privacy and Security Wardy is committed to protecting your privacy and data. All data stored with Wardy is encrypted and secured to prevent unauthorized access. Your personal information is collected, used, and shared in accordance with Wardy’s Privacy Policy.
While Wardy takes reasonable measures to protect your data, we are not liable for breaches resulting from your failure to safeguard your account credentials or unforeseen technological vulnerabilities. You acknowledge that storing sensitive information with Wardy is at your own risk, and you should take appropriate precautions.
7. Delivery of Messages and Packages Wardy will make reasonable efforts to deliver your messages and packages as instructed. However, delivery may be affected by inaccurate or outdated recipient information, failure of Trusted Contacts to activate the delivery process, or external factors such as shipping restrictions or recipient availability. Physical package delivery is subject to international shipping laws, customs regulations, and additional costs for special handling or remote locations. In the event of undeliverable items, Wardy will attempt to contact your Trusted Contacts for further instructions.
8. Limitation of Liability To the fullest extent permitted by law, Wardy disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose, non-infringement, and accuracy or reliability of the Service. Wardy’s liability is limited to the amount paid for the subscription in the 12 months preceding the claim. Wardy is not responsible for loss, damage, or delay in delivery caused by inaccurate information or external factors, unauthorized access to your account resulting from your negligence, or emotional or financial consequences arising from the content or timing of delivered messages.
9. Termination You may terminate your account at any time by contacting Wardy support. Wardy reserves the right to suspend or terminate your account for violation of these Terms, misuse of the Service, or non-payment of subscription fees. Upon termination, your data will be retained for a limited period to allow for recovery or transfer. After this period, your data will be permanently deleted.
10. Governing Law These Terms are governed by and construed in accordance with the laws of United States of America. Any disputes arising under these Terms will be resolved exclusively in the courts of the home base.
11. Modifications to Terms Wardy reserves the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of the Service after such changes constitutes your acceptance of the modified Terms.

13. Additional Provisions These Terms, along with the Privacy Policy, constitute the entire agreement between you and Wardy, superseding any prior agreements. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure of Wardy to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
